These Terms & Conditions (“Terms”) govern your use of the Forged Fitness website, online content, and any services, programmes, or products offered through it (including personal training, coaching, bootcamps, and events).
By accessing this website or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use this website or our services.
Forged Fitness operates in New Zealand and these Terms are governed by New Zealand law, including (without limitation):
- Consumer Guarantees Act 1993 (CGA)
- Fair Trading Act 1986 (FTA)
- Contract and Commercial Law Act 2017 (CCLA)
- Health and Safety at Work Act 2015 (HSWA)
- Privacy Act 2020
2. Not medical advice
All information on this website, and any training or coaching provided by Forged Fitness, is general fitness and wellbeing guidance only and does not constitute medical, physiotherapy, or dietetic advice.
You are responsible for:
- Consulting a doctor or qualified health professional before starting any new exercise or nutrition programme, especially if you have existing injuries, conditions, or concerns
- Informing us of any relevant health or injury information before participating in sessions
We may decline to train you, or request clearance from a health professional, if we believe it is unsafe to proceed.
3. Services we provide
Forged Fitness may offer:
- 1:1 personal training
- Small group training
- Bootcamps and specialised programmes (including Battle Camp)
- Corporate sessions and workshops
- Online or app-based training and programming
- Educational content, resources, and challenges
Specific details (session lengths, locations, inclusions, frequency, pricing) will be confirmed in writing, via email, app, or service description.
4. Your responsibilities
By participating in our services, you agree that you will:
- Provide accurate and honest information about your health, injuries, medications, and physical limitations
- Follow instructions and training guidance given by Forged Fitness
- Use equipment and facilities safely and respectfully
- Inform us immediately if you experience pain, dizziness, or any concerning symptoms
- Not train under the influence of alcohol, drugs, or any substance that may impair your judgement or physical capacity
- Respect other participants and staff
You acknowledge that physical training carries inherent risks, and while we take all reasonable steps to provide a safe environment, you participate at your own risk.
5. Bookings, cancellations, and lateness
Specific cancellation and rescheduling rules can be set out in a separate policy or client agreement, but typically include:
- Personal Training Sessions:
- Cancellations or reschedules must be made with at least [e.g. 12–24] hours’ notice
- Late cancellations or no-shows may be charged in full or counted as a used session
- Bootcamps / Programmes / Battle Camp:
- Start dates, duration, and payment terms will be clearly communicated
- Once a programme has commenced, fees are generally non-refundable, except where required by New Zealand consumer law
- Lateness:
- If you arrive late, your session may still finish at the scheduled time and the full session fee may still apply.
You are responsible for ensuring your contact details are up to date so you receive scheduling changes or updates.
6. Payments, pricing, and subscriptions
Prices for our services are listed on our website, in marketing material, or provided directly to you (e.g. via email or app).
- All prices are in New Zealand dollars (NZD) unless stated otherwise
- We may change prices from time to time; however, any price you have already agreed to for a current package or subscription will remain in place for that agreed term
- Payment is typically required in advance for sessions, programmes, or subscriptions
- For subscription services (e.g. weekly PT + programming), payments are made on a recurring basis until you cancel in accordance with the stated notice period
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
7. Refunds and credits
We do not generally provide refunds for:
- Change of mind
- Failure to attend scheduled sessions
- Non-use of part or all of a programme
However, we will always act in accordance with New Zealand consumer law, and may consider partial credits or transfers in exceptional circumstances (e.g. serious injury or illness, where supported by evidence).
Where a refund or remedy is required under the Consumer Guarantees Act 1993, we will comply with our legal obligations.
8. Health and safety
We are committed to providing a safe training environment in line with the Health and Safety at Work Act 2015.
We will:
- Take reasonable steps to identify and manage risks
- Provide instructions on safe exercise and equipment use
- Encourage you to train within your capacity
You agree to:
- Follow health and safety instructions
- Use equipment only as instructed
- Immediately report any injury, incident, or hazard
9. Website content and intellectual property
All content on this website, including logos, text, graphics, photos, videos, and programme material, is the intellectual property of Forged Fitness (or our licensors) unless otherwise stated.
You may:
- View and print content for your personal use only
You may not:
- Copy, reproduce, distribute, or exploit our content for commercial purposes
- Pass off our material as your own
- Use our logos or branding without prior written consent
10. Third-party links
Our website or social media may contain links to third-party websites or services. We are not responsible for the content, security, or privacy practices of those sites. Accessing them is at your own risk.
11. Limitation of liability
To the maximum extent permitted by New Zealand law, Forged Fitness will not be liable for any indirect, consequential, or special loss, or for any loss of profit, data, or opportunity arising from:
- Your use of this website
- Your participation in training, programmes, or events
- Any reliance on information provided on this site or in general guidance
Nothing in these Terms limits or excludes any rights you have under the Consumer Guarantees Act 1993 or our liability where it cannot be limited or excluded by law.
12. Privacy
Your use of this website and our services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information in line with the Privacy Act 2020.
